BLE Detailed Copyright Guide: Who Can Place Material on the BLE?
Provided the material which you want to put on the BLE falls within one of the situations where copying is lawful (see When can I put material on the BLE without infringing copyright?), any member of staff involved in teaching a course or another staff member acting on their behalf can digitise material and place material on the BLE. If you want to scan items under the CLA licence, you must first register as someone who is authorised to do scanning under the licence, and you should report details of each item which you want to scan before you scan it (see Scanning under the CLA licence).
If you do not have access to scanning equipment, a small number of self-service scanners are available at the IT Support Desk. The IT Department has also produced guidance on how to scan images.
If the item which you want to digitise is a reference work held by the Library (i.e. one which you cannot borrow), you can either scan from a photocopy, or you can ask the relevant Faculty Librarian to authorise the temporary loan of the copy to you for scanning purposes. If you are scanning from a photocopy, you should ensure that the copy is good enough to permit an accurate reproduction of the original, as this is a condition of our CLA licence (see Scanning under the CLA licence).
Students cannot scan items under the digitisation part of the CLA licence (see Scanning under the CLA licence), unless they are acting as employees of the School. However, students can place material on the BLE in other ways which do not infringe copyright. For example, students will not infringe copyright if they post material which:
- They created themselves - as they will own the copyright.
- Is out of copyright.
- Is used by the student in a way which constitutes fair dealing for criticism, review or reporting current events.
The School's IT Policies require students and staff to use the School's systems in ways which comply with copyright law. Students may not understand what they are allowed to do under copyright law, so staff should intervene if it appears that a student has posted material which infringes copyright.
