Recent years have seen increasing calls to reform international investment law. Within the context of the UNCITRAL Working Group III, discussions have focused on: (i) a lack of certainty and predictability of ISDS decisions, (ii) a lack of impartiality and independence of party-appointed arbitrations and (iii) the costs and duration of proceedings. Past ICSID rule amendments have taken incremental steps towards greater transparency and third-party participation. NGOs continue to advocate for reforms that protect human rights, the environment and public health. Meanwhile, the EU has proposed creating an Investment Court within the context of TTIP negotiations. This roundtable brings together some of the leading experts in the field to come up with innovative suggestions for rethinking international investment law.
