The interplay between M&A and treaty protection remains underexplored. This talk will examine how investors structure cross-border M&A to access investment treaty protection; the nature of disputes that emerge around and after these transactions; the doctrinal routes by which such disputes crystallise into investment claims; and the practical realities of enforcement, including impact of Operafund v Spain on the assignment of awards, and alternative routes to monetisation.

About the speaker
Hafsa Zayyan is a Partner in Quinn Emanuel’s London office, where she represents states, multinationals, and high-net-worth investors in international arbitration and complex commercial litigation across a range of practice areas including post-M&A disputes, shareholder and JV disputes, civil fraud and asset-tracing matters, and investment treaty claims.
